ਕਨੂੰਨ ਦੇ ਸ਼ਾਸਨ ਦੀ ਆਕਸਫੋਰਡ ਇੰਗਲਿਸ਼ ਡਿਕਸ਼ਨਰੀ ਵਿੱਚ ਪਰਿਭਾਸ਼ਾ ਇਸ ਤਰਾਂ ਹੈ: “ਸਮਾਜ ਵਿੱਚ ਕਨੂੰਨ ਦਾ ਅਧਿਕਾਰ ਅਤੇ ਪ੍ਰਭਾਵ, ਖ਼ਾਸਕਰ ਜਦੋਂ ਇਸ ਨੂੰ ਵਿਅਕਤੀਗਤ ਅਤੇ ਸੰਸਥਾਗਤ ਵਿਵਹਾਰ ਲਈ ਇੱਕ ਰੁਕਾਵਟ ਵਜੋਂ ਵੇਖਿਆ ਜਾਂਦਾ ਹੈ; ਸਰਕਾਰ ਵਿੱਚ ਸ਼ਾਮਲ ਲੋਕਾਂ ਸਮੇਤ ਸਮਾਜ ਦੇ ਸਾਰੇ ਮੈਂਬਰਾਂ ਨੂੰ ਜਨਤਕ ਤੌਰ ਤੇ ਜਾਰੀ ਕੀਤੇ ਹੋਏ ਕਨੂੰਨੀ ਕੋਡਾਂ ਅਤੇ ਪ੍ਰਕਿਰਿਆਵਾਂ ਦੇ ਅਧੀਨ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ।"[2] ਸ਼ਬਦ "ਕਨੂੰਨ ਦੇ ਸ਼ਾਸਨ" ਇੱਕ ਰਾਜਨੀਤਿਕ ਸਥਿਤੀ ਨੂੰ ਦਰਸਾਉਂਦਾ ਹੈ, ਕਿਸੇ ਵਿਸ਼ੇਸ਼ ਕਾਨੂੰਨੀ ਨਿਯਮ ਨੂੰ ਨਹੀਂ।

ਇਹ ਕਲਾ ਕ੍ਰਿਤ ਕਨੂੰਨ ਦੇ ਨਿਆਂਇਕ ਅਤੇ ਵਿਧਾਨਕ ਦੋਵਾਂ ਪੱਖਾਂ ਨੂੰ ਦਰਸਾਉਂਦੀ ਹੈ। ਤਖਤ ਤੇ ਬੈਠੀ ਔਰਤ ਦੋਸ਼ੀ ਨੂੰ ਸਜ਼ਾ ਦੇਣ ਲਈ ਇੱਕ ਹੱਥ ਤਲਵਾਰ ਰੱਖਦੀ ਹੈ ਤੇ ਦੂਜੇ ਹੱਥ ਹੋਣਹਾਰ ਲਈ ਇਨਾਮ ਹੈ। ਉਸ ਦੇ ਸਿਰ ਦੇ ਦੁਆਲੇ ਪ੍ਰਭਾ ਮੰਡਲ ਹੈ, ਅਤੇ ਛੱਤਰ ਦੇ ਮਿਨਰਵਾ ਧਰਮ ਅਤੇ ਬੁੱਧੀ ਦਾ ਪ੍ਰਤੀਕ ਹੈ।[1]

ਇਸ ਮੁਹਾਵਰੇ ਦੀ ਵਰਤੋਂ ਸ਼ੁਰੂਆਤ ਦੀ ਖੋਜ 16 ਵੀਂ ਸਦੀ ਦੇ ਬ੍ਰਿਟੇਨ ਵਿੱਚੋਂ ਕੀਤੀ ਜਾ ਸਕਦੀ ਹੈ, ਅਤੇ ਅਗਲੀ ਸਦੀ ਵਿੱਚ ਸਕਾਟਲੈਂਡ ਦੇ ਧਰਮ ਸ਼ਾਸਤਰੀ ਸੈਮੂਅਲ ਰਦਰਫ਼ਰਡ ਨੇ ਇਸ ਨੂੰ ਰਾਜਿਆਂ ਦੇ ਬ੍ਰਹਮ ਅਧਿਕਾਰ ਦੇ ਵਿਰੁੱਧ ਬਹਿਸ ਕਰਨ ਲਈ ਵਰਤਿਆ।[3] ਜੌਨ ਲੌਕ ਨੇ ਲਿਖਿਆ ਕਿ ਸਮਾਜ ਵਿੱਚ ਅਜ਼ਾਦੀ ਦਾ ਅਰਥ ਸਿਰਫ ਇੱਕ ਵਿਧਾਨ ਸਭਾ ਦੁਆਰਾ ਬਣਾਏ ਕਨੂੰਨਾਂ ਦੇ ਅਧੀਨ ਹੋਣਾ ਹੈ ਜੋ ਹਰੇਕ ਉੱਤੇ ਲਾਗੂ ਹੁੰਦੇ ਹਨ। ਇੱਕ ਵਿਅਕਤੀ ਦੀ ਆਜ਼ਾਦੀ ਦਾ ਜੀਵਨ ਇਸ ਤੋਂ ਬਿਨਾਂ ਸਰਕਾਰੀ ਅਤੇ ਨਿਜੀ ਪਾਬੰਦੀਆਂ ਤੋਂ ਮੁਕਤ ਹੁੰਦਾ ਹੈ। “ਕਨੂੰਨ ਦਾ ਰਾਜ” 19 ਵੀਂ ਸਦੀ ਵਿੱਚ ਬ੍ਰਿਟਿਸ਼ ਨਿਆਂ ਸ਼ਾਸਤਰੀ ਏਵੀ ਡਾਈਸੀ ਦੁਆਰਾ ਹੋਰ ਮਸ਼ਹੂਰ ਕੀਤਾ ਗਿਆ। ਹਾਲਾਂਕਿ,ਇਹ ਸਿਧਾਂਤ, ਜੇ ਇਸ ਨੂੰ ਇੱਕ ਵਾਕ ਹੀ ਨਾ ਮੰਨਿਆ ਜਾਵੇ, ਪੁਰਾਣੇ ਚਿੰਤਕਾਂ ਦੁਆਰਾ ਮਾਨਤਾ ਪ੍ਰਾਪਤ ਸੀ; ਉਦਾਹਰਣ ਵਜੋਂ, ਅਰਸਤੂ ਨੇ ਲਿਖਿਆ: "ਇਹ ਵਧੇਰੇ ਉਚਿਤ ਹੈ ਕਿ ਕਿਸੇ ਵੀ ਨਾਗਰਿਕ ਨਾਲੋਂ ਕਨੂੰਨ ਨੂੰ ਰਾਜ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ"।[4]

ਕਨੂੰਨ ਦੇ ਸ਼ਾਸਨ ਤੋਂ ਭਾਵ ਹੈ ਕਿ ਹਰ ਵਿਅਕਤੀ ਕਾਨੂੰਨ ਦੇ ਅਧੀਨ ਹੈ, ਜਿਸ ਵਿੱਚ ਉਹ ਲੋਕ ਸ਼ਾਮਲ ਹਨ ਜੋ ਕਨੂੰਨ ਬਣਾਉਣ ਵਾਲੇ, ਕਨੂੰਨ ਲਾਗੂ ਕਰਨ ਵਾਲੇ ਅਧਿਕਾਰੀ ਅਤੇ ਜੱਜ ਹਨ।[5] ਇਸ ਅਰਥ ਵਿੱਚ, ਇਹ ਇੱਕ ਰਾਜਸ਼ਾਹੀ ਜਾਂ ਸਰਬੋਤਮ ਸ਼ਾਸਨ ਦੇ ਵਿਪਰੀਤ ਖੜ੍ਹਦਾ ਹੈ ਜਿੱਥੇ ਸ਼ਾਸਕ ਕਨੂੰਨ ਤੋਂ ਉਪਰ ਹੁੰਦੇ ਹਨ। ਕਨੂੰਨ ਦੇ ਸ਼ਾਸਨ ਦੀ ਘਾਟ ਲੋਕਤੰਤਰ ਅਤੇ ਰਾਜਤੰਤਰ ਦੋਵਾਂ ਵਿੱਚ ਵੇਖੀ ਜਾ ਸਕਦੀ ਹੈ।

ਇਤਿਹਾਸ ਸੋਧੋ

ਹਾਲਾਂਕਿ ਆਧੁਨਿਕ ਸਮੇਂ ਵਿੱਚ "ਕਨੂੰਨ ਦਾ ਰਾਜ" ਭਾਵ ਨੂੰ ਪ੍ਰਸਿੱਧ ਬਣਾਉਣ ਦਾ ਸਿਹਰਾ ਆਮ ਤੌਰ 'ਤੇ ਏਵੀ ਡਾਈਸੀ ਨੂੰ ਦਿੱਤਾ ਜਾਂਦਾ ਹੈ,[6][7] ਕਨੂੰਨੀ ਸੰਕਲਪ ਦੇ ਵਿਕਾਸ ਨੂੰ ਇਤਿਹਾਸ ਵਿੱਚ ਬਹੁਤ ਸਾਰੀਆਂ ਪੁਰਾਣੀਆਂ ਸਭਿਅਤਾਵਾਂ, ਜਿਵੇਂ ਕਿ ਪ੍ਰਾਚੀਨ ਯੂਨਾਨ, ਚੀਨ, ਮੇਸੋਪੋਟੇਮੀਆ, ਭਾਰਤ ਅਤੇ ਰੋਮ ਵਿੱਚ ਲ਼ੱਭਿਆ ਜਾ ਸਕਦਾ ਹੈ।[8]

ਪੁਰਾਤਨਤਾ ਸੋਧੋ

ਪੱਛਮ ਵਿਚ, ਪ੍ਰਾਚੀਨ ਯੂਨਾਨੀ ਲੋਕ ਸਭ ਤੋਂ ਚੰਗੇ ਆਦਮੀਆਂ ਦੁਆਰਾ ਸ਼ਾਸਨ ਨੂੰ ਸਰਕਾਰ ਦਾ ਸਭ ਤੋਂ ਉੱਤਮ ਰੂਪ ਮੰਨਦੇ ਸਨ। ਪਲੇਟੋ ਨੇ ਇੱਕ ਆਦਰਸ਼ ਰਾਜਸੱਤਾ ਦੀ ਵਕਾਲਤ ਕੀਤੀ ਜੋ ਇੱਕ ਆਦਰਸ਼ ਦਾਰਸ਼ਨਿਕ ਰਾਜਾ ਦਾ ਸ਼ਾਸਨ ਸੀ, ਜੋ ਕਨੂੰਨ ਤੋਂ ਉਪਰ ਸੀ।[9] ਇਸ ਦੇ ਬਾਵਜੂਦ ਪਲਾਟੋ ਨੇ ਉਮੀਦ ਜਤਾਈ ਕਿ ਉੱਤਮ ਪੁਰਸ਼ ਸਥਾਪਤ ਕਾਨੂੰਨਾਂ ਦਾ ਸਤਿਕਾਰ ਕਰਨਗੇ।

ਮੱਧ ਯੁੱਗ ਸੋਧੋ

ਇਸਲਾਮੀ ਨਿਆਂ ਸ਼ਾਸਤਰ ਵਿੱਚ ਸੱਤਵੀਂ ਸਦੀ ਵਿੱਚ ਕਨੂੰਨ ਦਾ ਨਿਯਮ ਬਣਾਇਆ ਗਿਆ ਸੀ, ਤਾਂ ਜੋ ਕੋਈ ਵੀ ਅਧਿਕਾਰੀ ਕਾਨੂੰਨ ਤੋਂ ਉਪਰ ਹੋਣ ਦਾ ਦਾਅਵਾ ਨਾ ਕਰ ਸਕੇ, ਖ਼ਲੀਫ਼ਾ ਵੀ ਨਹੀਂ।[10]

ਸ਼ੁਰੂਆਤੀ ਆਧੁਨਿਕ ਕਾਲ ਸੋਧੋ

ਇਸ ਅੰਗਰੇਜ਼ੀ ਮੁਹਾਵਰੇ ਦੀ ਪਹਿਲੀ ਜਾਣੀ-ਪਛਾਣੀ ਵਰਤੋਂ ਸੰਨ 1500 ਦੇ ਆਸ ਪਾਸ ਹੋਈ।[11] "ਕਾਨੂੰਨ ਦਾ ਰਾਜ" ਮੁਹਾਵਰੇ ਦੀ ਇੱਕ ਹੋਰ ਉਦਾਹਰਨ ਇੰਗਲੈਂਡ ਦੇ ਜੇਮਜ਼ ਪਹਿਲੇ ਨੇ 1610 ਵਿਚ, ਹਾਊਸ ਆਫ ਕਾਮਨਜ਼ ਦੀ ਪਟੀਸ਼ਨ ਵਿੱਚ ਮਿਲਦੀ ਹੈ।
